MPG Open-Access-Net Day

Dieser erste Workshop für das MPG-OA-Netzwerk und andere MPG-Angehörige legt seinen Schwerpunkt auf (US-amerikanisches) Urheberrecht. Bitte beachten Sie, dass dieser Workshop unter Berücksichtigung der nationalen Open-Access-Tage in Berlin geplant wurde, die am 09. und 10. Oktober stattfinden.

We are very pleased that we have gained Prof. Michael Seadle, Director, Institute for Library and Information Science, Humboldt University, Berlin as the speaker on US Copyright Law. There will also be a presentation by Anja Lengenfelder on the current status of the MPDL §137l UrhG project.

The workshop by Prof. Seadle will cover key elements of the US copyright law (Title 17 of the US Code). Particular attention will be given to US concepts of "fair use" (17 USC 107), exemptions for libraries (17 USC 108), "orphan" copyrights, and classroom use (17 USC 110). The workshop will include an introduction to the basic principles of the US and Anglo-American "common law" legal system, the responsibilities of the various Federal courts, and a number of court decisions that have the force of law in the US. In the second part of the workshop the presenter will answer questions about specific copyright problems from the point of view of US law. Parallels and contrasts with German law will be mentioned where relevant. Note that no legal advice will be offered during the workshop, only informed opinion.  The workshop will be presented in English, but questions and answers can be in either English or German.
